Terms of Use

1. Acceptance of Terms

By accessing or using the ProjectsAsia Defect Application ("the Application") provided at palapp.work, you agree to be bound by these Terms of Use. If you do not agree to these terms, you may not access or use the Application. Your continued use of the Application constitutes ongoing acceptance of these terms and any future amendments.

2. Description of Service

The ProjectsAsia Defect Application is a construction defect management system designed for tracking, documenting, photographing, assigning, and managing defects in construction projects. The Application is operated by ProjectsAsia Group of Companies and is intended exclusively for authorized project professionals.

3. User Accounts

• User accounts are created and managed by system administrators. You may not create your own account independently.
• You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
• You must provide accurate and up-to-date information when prompted.
• You must not share your account credentials with any other person.
• You must notify the system administrator immediately if you suspect any unauthorized use of your account.

4. Acceptable Use

You agree to use the Application only for its intended purposes of construction defect management. You must not:

• Use the Application for any unlawful, fraudulent, or unauthorized purpose
• Attempt to gain unauthorized access to any part of the Application, other accounts, or connected systems
• Upload, transmit, or distribute malicious code, viruses, or harmful content
• Interfere with or disrupt the integrity or performance of the Application or its data
• Reverse engineer, decompile, or attempt to extract the source code of the Application
• Use the Application to store or transmit material that violates applicable laws or third-party rights
• Falsify, misrepresent, or manipulate defect records or project data

5. Intellectual Property

All content, features, functionality, software, design, and materials of the Application — including but not limited to logos, text, graphics, and interfaces — are owned by or licensed to ProjectsAsia Group of Companies and are protected by applicable intellectual property laws.

Defect records, photographs, and project data entered by users remain associated with the respective project organization. ProjectsAsia does not claim ownership of user-generated content.

6. Google Sign-In

Users may authenticate using Google Sign-In. By doing so, you also agree to Google's Terms of Service and Privacy Policy. The Application accesses only your email address and authentication token for identity verification purposes. No other Google account data is accessed.

7. Data and Content

• You are solely responsible for the accuracy, completeness, and legality of all defect reports, photographs, and data you enter into the Application.
• You must not upload photographs or content that violates privacy rights, intellectual property rights, or any applicable laws.
• ProjectsAsia may use aggregated and anonymized data derived from application usage for service improvement purposes.

8. Limitation of Liability

The Application is provided "as is" and "as available" without warranties of any kind. To the fullest extent permitted by law, ProjectsAsia Group of Companies shall not be liable for:

• Any loss or corruption of data due to technical failures or service interruptions
• Errors, inaccuracies, or omissions in defect reports entered by users
• Any decisions made or actions taken based on information in the Application
• Unauthorized access to your account resulting from your failure to secure credentials
• Any indirect, incidental, or consequential damages arising from use of the Application

9. Service Availability and Termination

ProjectsAsia reserves the right to modify, suspend, or discontinue the Application at any time, with or without notice. ProjectsAsia may terminate or suspend your access to the Application at any time, without prior notice, if you violate these Terms of Use or if required for legal or security reasons.

Users may request account closure by contacting the system administrator or ProjectsAsia directly.

10. Governing Law

These Terms of Use are governed by and construed in accordance with the laws of the Kingdom of Thailand. Any disputes arising from or related to these terms or the use of the Application shall be subject to the exclusive jurisdiction of the courts of Thailand.

11. Changes to These Terms

ProjectsAsia may revise these Terms of Use at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Application after any changes constitutes your acceptance of the revised terms. We encourage you to review these terms periodically.

1. การยอมรับข้อกำหนด

การเข้าถึงหรือใช้งาน ProjectsAsia Defect Application ("แอปพลิเคชัน") ที่ palapp.work ถือว่าคุณยอมรับข้อกำหนดการใช้งานเหล่านี้ หากคุณไม่เห็นด้วยกับข้อกำหนดเหล่านี้ คุณไม่สามารถเข้าถึงหรือใช้แอปพลิเคชันได้ การใช้งานแอปพลิเคชันอย่างต่อเนื่องถือเป็นการยอมรับข้อกำหนดเหล่านี้และการแก้ไขในอนาคต

2. รายละเอียดบริการ

ProjectsAsia Defect Application เป็นระบบจัดการ Defect ในงานก่อสร้าง ออกแบบมาเพื่อการติดตาม บันทึก ถ่ายภาพ มอบหมาย และจัดการ Defect ในโครงการก่อสร้าง แอปพลิเคชันดำเนินการโดย ProjectsAsia Group of Companies และมีไว้สำหรับผู้เชี่ยวชาญโครงการที่ได้รับอนุญาตเท่านั้น

3. บัญชีผู้ใช้

• บัญชีผู้ใช้ถูกสร้างและจัดการโดยผู้ดูแลระบบ คุณไม่สามารถสร้างบัญชีด้วยตนเองได้
• คุณรับผิดชอบในการรักษาความลับของข้อมูลการเข้าสู่ระบบ และกิจกรรมทั้งหมดที่เกิดขึ้นภายใต้บัญชีของคุณ
• คุณต้องให้ข้อมูลที่ถูกต้องและเป็นปัจจุบันเมื่อได้รับการร้องขอ
• คุณต้องไม่แบ่งปันข้อมูลการเข้าสู่ระบบกับบุคคลอื่น
• คุณต้องแจ้งผู้ดูแลระบบทันทีหากสงสัยว่ามีการใช้งานบัญชีของคุณโดยไม่ได้รับอนุญาต

4. การใช้งานที่ยอมรับได้

คุณตกลงที่จะใช้แอปพลิเคชันเพื่อวัตถุประสงค์การจัดการ Defect ในงานก่อสร้างเท่านั้น คุณต้องไม่:

• ใช้แอปพลิเคชันเพื่อวัตถุประสงค์ที่ผิดกฎหมาย หลอกลวง หรือไม่ได้รับอนุญาต
• พยายามเข้าถึงส่วนใดๆ ของแอปพลิเคชัน บัญชีอื่น หรือระบบที่เชื่อมต่อโดยไม่ได้รับอนุญาต
• อัปโหลด ส่ง หรือเผยแพร่โค้ดที่เป็นอันตราย ไวรัส หรือเนื้อหาที่เป็นภัย
• แทรกแซงหรือรบกวนความสมบูรณ์หรือประสิทธิภาพของแอปพลิเคชันหรือข้อมูล
• ทำวิศวกรรมย้อนกลับ แยกส่วนประกอบ หรือพยายามดึงซอร์สโค้ดของแอปพลิเคชัน
• ใช้แอปพลิเคชันเพื่อจัดเก็บหรือส่งเนื้อหาที่ละเมิดกฎหมายหรือสิทธิ์ของบุคคลที่สาม
• ปลอมแปลง บิดเบือน หรือจัดการบันทึก Defect หรือข้อมูลโครงการ

5. ทรัพย์สินทางปัญญา

เนื้อหา ฟีเจอร์ ฟังก์ชัน ซอฟต์แวร์ การออกแบบ และวัสดุทั้งหมดของแอปพลิเคชัน รวมถึงแต่ไม่จำกัดเฉพาะโลโก้ ข้อความ กราฟิก และอินเทอร์เฟซ เป็นของ ProjectsAsia Group of Companies หรือได้รับอนุญาตให้ใช้ และได้รับการคุ้มครองโดยกฎหมายทรัพย์สินทางปัญญาที่เกี่ยวข้อง

บันทึก Defect ภาพถ่าย และข้อมูลโครงการที่ผู้ใช้ป้อนจะยังคงเชื่อมโยงกับองค์กรโครงการที่เกี่ยวข้อง ProjectsAsia ไม่อ้างสิทธิ์ความเป็นเจ้าของเนื้อหาที่ผู้ใช้สร้าง

6. Google Sign-In

ผู้ใช้อาจยืนยันตัวตนโดยใช้ Google Sign-In โดยการทำเช่นนี้ คุณยังยอมรับ ข้อกำหนดการให้บริการของ Google และ นโยบายความเป็นส่วนตัวของ Google แอปพลิเคชันเข้าถึงเฉพาะที่อยู่อีเมลและโทเค็นการยืนยันตัวตนเพื่อวัตถุประสงค์การตรวจสอบบัญชีเท่านั้น ไม่มีการเข้าถึงข้อมูลบัญชี Google อื่นๆ

7. ข้อมูลและเนื้อหา

• คุณรับผิดชอบแต่เพียงผู้เดียวต่อความถูกต้อง ความครบถ้วน และความถูกต้องตามกฎหมายของรายงาน Defect ภาพถ่าย และข้อมูลทั้งหมดที่คุณป้อนในแอปพลิเคชัน
• คุณต้องไม่อัปโหลดภาพถ่ายหรือเนื้อหาที่ละเมิดสิทธิ์ความเป็นส่วนตัว สิทธิ์ทรัพย์สินทางปัญญา หรือกฎหมายที่บังคับใช้
• ProjectsAsia อาจใช้ข้อมูลรวมและไม่ระบุตัวตนที่ได้จากการใช้งานแอปพลิเคชันเพื่อวัตถุประสงค์การปรับปรุงบริการ

8. ข้อจำกัดความรับผิดชอบ

แอปพลิเคชันให้บริการ "ตามสภาพ" และ "ตามที่มี" โดยไม่มีการรับประกันใดๆ ในขอบเขตสูงสุดที่กฎหมายอนุญาต ProjectsAsia Group of Companies จะไม่รับผิดชอบสำหรับ:

• การสูญหายหรือเสียหายของข้อมูลเนื่องจากความล้มเหลวทางเทคนิคหรือการหยุดชะงักของบริการ
• ข้อผิดพลาด ความไม่ถูกต้อง หรือการขาดข้อมูลในรายงาน Defect ที่ผู้ใช้ป้อน
• การตัดสินใจหรือการดำเนินการใดๆ ที่กระทำโดยอิงข้อมูลในแอปพลิเคชัน
• การเข้าถึงบัญชีของคุณโดยไม่ได้รับอนุญาต อันเกิดจากความไม่ระมัดระวังในการรักษาข้อมูลรับรอง
• ความเสียหายทางอ้อม ที่เกิดขึ้นบังเอิญ หรือที่เป็นผลสืบเนื่องจากการใช้แอปพลิเคชัน

9. ความพร้อมใช้งานและการยุติบริการ

ProjectsAsia ขอสงวนสิทธิ์ในการแก้ไข ระงับ หรือหยุดให้บริการแอปพลิเคชันได้ตลอดเวลา ไม่ว่าจะมีการแจ้งล่วงหน้าหรือไม่ก็ตาม ProjectsAsia อาจยุติหรือระงับการเข้าถึงของคุณได้ตลอดเวลาหากคุณละเมิดข้อกำหนดการใช้งานเหล่านี้ หรือหากจำเป็นด้วยเหตุผลทางกฎหมายหรือความปลอดภัย

ผู้ใช้สามารถขอปิดบัญชีได้โดยติดต่อผู้ดูแลระบบหรือ ProjectsAsia โดยตรง

10. กฎหมายที่ใช้บังคับ

ข้อกำหนดการใช้งานเหล่านี้อยู่ภายใต้บังคับและตีความตามกฎหมายของราชอาณาจักรไทย ข้อพิพาทใดๆ ที่เกิดขึ้นจากหรือเกี่ยวข้องกับข้อกำหนดเหล่านี้หรือการใช้งานแอปพลิเคชัน จะอยู่ภายใต้เขตอำนาจของศาลไทย

11. การเปลี่ยนแปลงข้อกำหนด

ProjectsAsia อาจแก้ไขข้อกำหนดการใช้งานเหล่านี้ได้ตลอดเวลา การเปลี่ยนแปลงจะถูกโพสต์บนหน้านี้พร้อมวันที่มีผลบังคับใช้ที่อัปเดตแล้ว การใช้งานแอปพลิเคชันอย่างต่อเนื่องหลังจากมีการเปลี่ยนแปลงถือเป็นการยอมรับข้อกำหนดที่แก้ไขแล้ว เราขอแนะนำให้คุณตรวจสอบข้อกำหนดเหล่านี้เป็นระยะๆ
